Sinossi. Dopo aver brevemente ricostruito la vicenda processuale da cui muove la sentenza della Cassazione in commento, il contributo si concentra sui principi in essa contenuti che aggiungono ulteriori elementi agli approdi ermeneutici della precedente pronuncia del 2020 riguardo all’interpretazione dell’art. 2, d.lgs. n. 81/2015, in riferimento al rapporto di lavoro dei riders. Seguono una valutazione dell’impostazione fatta propria dalla Corte e delle considera-zioni sui dubbi ancora irrisolti in materia, anche rispetto alla nuova formulazione dell’articolo.

Abstract. After briefly reconstructing the proceedings that led to the Court of Cassation ruling in question, the article focuses on the principles contained therein, which add further elements to the interpretative conclusions of the previous ruling of 2020 regarding the interpretation of Article 2 of Legislative Decree No. 81/2015, with reference to the employment relationship of delivery riders. This is followed by an assessment of the approach adopted by the Court and considerations on the still unresolved doubts on the matter, also with regard to the new wording of the article.
